FINANCIAL REMEDIES:Malialis v Malialis

By Samantha Bangham, Law Reporter - 02 November 2012

(Court of Appeal, Thorpe, Lewison LJJ, Hedley J, 24 October 2012)

The husband appealed financial orders made following divorce. The appeal was partly allowed. The fundamental division of assets could not be interfered with. However, the judge's rejection of the husband's argument that the period which he should be kept out of assets ought to be limited meant the wife's indemnity against potential future liability could result in a windfall.
