In May 2012, the President of the Family Division issued guidance from the Legal Services Commission (LSC) for solicitors applying to the LSC for prior authority for expert costs in certain circumstances. Among several points, the guidance states that applications should only be made for exceptional rates or where the costs sought are unusual or unusually high. The full guidance can be downloaded below.
The President was asked to issue the guidance during the course of proceedings in Re DS (Expert Evidence) [2012] EWHC 1442 (Fam) (see Related Article).
