EXPERT EVIDENCE: Re R (Instruction of Expert) [2012] EWCA Civ 687

(Court of Appeal, Thorpe, Aikens, Black LJJ, 4 May 2012)

The father appealed the decision not to instruct an expert who dealt with the transmission of sexually transmitted diseases. The decision was made on the grounds of delay and because the child had suffered from HPV previously but that had been treated and she was given a clean bill of health.

Appeal dismissed. The reasoning of the circuit judge had been sound.
