SEXUAL ABUSE:SB v A Local Authority and Ors [2012] EWCA Civ 1269

By Samantha Bangham, Law Reporter - 19 October 2012

(Court of Appeal, Arden, Sullivan LJJ, 10 October 2012)

The father appealed against a finding of fact that he had exposed himself, indecently touched and raped his daughter, who was now 18, on several occasions. There was a history of established incest in wider family and the girl's cousins were conceived by their maternal aunt and maternal grandfather. One of the cousins died as a result of a severe genetic defect. The father was convicted and imprisoned for 5 1/2 years.

Appeal dismissed. The judge's essential decision that the core of the girl's allegations was true was properly open to her, and the manner in which she went about her task was exemplary
